Factors to Consider When Choosing a Colorado Guardian

Choosing a guardian in Colorado is a crucial decision that impacts the well-being and future of an individual, particularly if the person is a minor or an incapacitated adult. The right guardian will ensure that the person under their care referred to as the ward, receives the appropriate care, support, and protection. Baker Law Group, a prominent Colorado law firm, provides valuable guidance on the essential factors to consider when selecting a guardian.

Understanding Guardianship in Colorado

Before diving into the factors to consider, it’s essential to understand the concept of guardianship in Colorado. A guardian is an individual appointed by the court to make decisions on behalf of a minor or an incapacitated adult. This role encompasses various responsibilities, including managing personal care, living arrangements, and medical decisions for the ward.

Guardianship is governed by the Colorado Probate Code, which outlines the legal framework and procedures for appointing a guardian. The court prioritizes the best interests of the ward when making guardianship decisions, ensuring that the selected guardian is fit and capable of fulfilling their duties.

Key Factors to Consider When Choosing a Guardian

  1. Relationship with the Ward

One of the primary factors to consider is the potential guardian’s relationship with the ward. A guardian with a close, positive relationship with the ward is more likely to understand their needs and preferences. This relationship can provide emotional stability and continuity, which is especially important for minors and individuals with cognitive impairments.

  1. Ability to Meet the Ward’s Needs

The prospective guardian must have the ability to meet the ward’s physical, emotional, and financial needs. This includes having the time, resources, and willingness to take on the responsibilities associated with guardianship. It’s essential to evaluate the guardian’s lifestyle, health, and financial stability to ensure they can provide the necessary care.

  1. Understanding of Guardianship Responsibilities

Guardianship involves significant responsibilities, including making medical decisions, managing finances, and ensuring the ward’s overall well-being. The chosen guardian should have a clear understanding of these duties and be prepared to handle them effectively. This may involve attending court hearings, submitting reports, and collaborating with other professionals, such as doctors and social workers.

  1. Values and Beliefs

The guardian’s values and beliefs should align with those of the ward or the ward’s family. This alignment is crucial for ensuring that the guardian respects and upholds the ward’s cultural, religious, and personal values. For instance, if the ward’s family values education highly, the guardian should prioritize the ward’s educational needs and aspirations.

  1. Location and Accessibility

The guardian’s location and accessibility play a significant role in their ability to provide consistent care. It’s generally preferable to choose a guardian who lives nearby or is willing to relocate if necessary. Proximity allows for regular visits, easier management of the ward’s daily activities, and quicker response to emergencies.

  1. Age and Health of the Guardian

The age and health of the prospective guardian are important considerations. A guardian should be in good health and have the physical stamina to care for the ward. Additionally, the guardian’s age should be considered about the ward’s age and expected duration of guardianship. For example, an elderly guardian may not be the best choice for a young child who will need care for many years.

  1. Willingness to Serve

Not everyone is willing or able to take on the role of a guardian despite being capable. It’s essential to have an open and honest conversation with the potential guardian to ensure they are willing to accept the responsibility and commit to the long-term care of the ward. This discussion should cover the expectations, potential challenges, and the level of support the guardian will receive from other family members or professionals.

  1. Legal and Financial Background

A thorough background check is necessary to ensure that the prospective guardian has no legal or financial issues that could impede their ability to serve effectively. This includes checking for any criminal history, bankruptcy, or ongoing legal disputes. The guardian should have a clean record and demonstrate sound financial management skills.

  1. Compatibility with Co-Guardians or Conservators

In some cases, a ward may have multiple guardians or a combination of a guardian and a conservator. It’s important to ensure that all parties can work together harmoniously and have compatible approaches to the ward’s care. Effective communication and collaboration are key to providing cohesive and comprehensive support for the ward.

  1. References and Recommendations

Seeking references and recommendations from trusted individuals can provide valuable insights into the prospective guardian’s character, reliability, and suitability for the role. Family members, friends, and professionals who have interacted with the potential guardian can offer a well-rounded perspective on their capabilities and commitment.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
