Guardianship in Texas: Essential Steps and Common Mistakes to Avoid

Guardianship in Texas is a sensitive and complex legal process that often causes stress for families facing difficult decisions about caring for their loved ones. Understanding Texas guardianship laws is crucial, whether caring for an elderly parent, a disabled family member, or a minor child. Mistakes made during the guardianship process can lead to delays, legal complications, and emotional strain. Knowing the essential steps and common pitfalls helps avoid unnecessary stress and ensures a smoother process for everyone involved.

Guardianship in TexasGuardianship in Texas

Guardianship in Texas involves appointing someone (a guardian) to legally manage personal, financial, or medical decisions for another individual (the ward). Texas guardianship can apply to both adults and minors. Courts in Texas take guardianship seriously, carefully reviewing each case to protect the rights and dignity of the person under guardianship.

Guardianships in Texas typically fall into two categories:

Guardianship of the Person

Guardianship of the person grants authority over medical and personal decisions, including healthcare, living arrangements, and day-to-day care.

Guardianship of the Estate

Guardianship of the estate involves managing financial decisions and assets, including property, bank accounts, and investments on behalf of the ward.

Sometimes, courts appoint one guardian to oversee both areas, depending on the individual’s needs.

Essential Steps to Establish Guardianship in Texas

Determine the Necessity of Guardianship

Before initiating guardianship proceedings, ensure guardianship is genuinely necessary. Texas courts favor less restrictive alternatives whenever possible, such as powers of attorney or supported decision-making agreements. Guardianship should be a last resort when other options do not sufficiently protect the individual.

Filing the Guardianship Application

To establish guardianship, apply to the Texas probate court located in the county where the potential ward resides. The application must detail why guardianship is necessary, identify the proposed guardian, and explain the guardian’s qualifications.

Providing Notice to Interested Parties

Once the application is filed, Texas guardianship laws require that interested parties—such as family members and the potential ward—receive notice. The court ensures transparency and fairness by requiring notification to all relevant individuals.

Court Investigation and Evaluation

The court will appoint an investigator or a guardian ad litem to thoroughly review the case. They evaluate the ward’s condition, interview family members, and assess the suitability of the proposed guardian. The investigator then submits a detailed report to the judge.

Attend the Guardianship Hearing

During the hearing, the judge reviews evidence, hears testimony, and considers recommendations from the investigator. The court determines whether guardianship is appropriate and confirms the guardian’s appointment if approved.

Fulfill Ongoing Guardianship Responsibilities

Once appointed, Texas guardians are required to report regularly to the court. Guardians of the estate must maintain accurate financial records, while guardians of the person submit periodic reports detailing the ward’s condition and care.

Common Mistakes in Texas Guardianship and How to Avoid Them

Avoiding mistakes is essential to a smooth guardianship process. Here are common pitfalls that Texas families often encounter and how to prevent them:

Mistake 1: Choosing the Wrong Type of Guardianship

Selecting inappropriate guardianship types can lead to unnecessary legal complications. Identify whether guardianship of the person, the estate, or both is necessary. Consulting a Texas guardianship lawyer ensures the correct type of guardianship is established from the beginning.

Mistake 2: Delaying the Guardianship Process

Delays in filing guardianship applications can result in extended periods where the ward lacks necessary protection. Promptly addressing the need for guardianship helps ensure vital decisions are made for your loved one without interruption.

Mistake 3: Failing to Explore Alternatives

Texas courts emphasize exploring alternatives before granting guardianship. Demonstrate to the court that less restrictive options were considered and found inadequate. If you skip this crucial step, the court may reject the guardianship application.

Mistake 4: Inadequate Documentation

Insufficient documentation slows down the guardianship process. Provide complete and accurate medical records, financial statements, and supporting documentation to clearly support the necessity of guardianship.

Mistake 5: Overlooking Annual Reporting Requirements

Failure to submit mandatory annual reports can jeopardize guardianship status. Guardians must keep detailed records and adhere strictly to court requirements, ensuring compliance and continuity of guardianship.

Mistake 6: Trying to Navigate Guardianship Without Legal Help

Guardianship laws in Texas can be complex, and mistakes are common for those without professional guidance. Engaging an experienced Texas guardianship lawyer like those at Baker Law Group, PLLC, helps you understand your responsibilities clearly and ensures compliance with Texas guardianship laws.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
