Understanding Colorado Defamation

Under Colorado law, defamation is defined as any intentional or negligent act that results in publishing false or derogatory information about another person, harming that person’s reputation.

Defamation can be either written (libel) or spoken (slander). Libel is defamation that is written down, such as in an article or social media post. Slander is defamation that is spoken, such as in a conversation or during a broadcast.

Defamation can also occur when someone implies something false about another person. An example is “Dexter Smith stole from his employer.” If this is untrue and making the statement damages Dexter’s reputation or ability to work, it is defamation.

To prove defamation, the following elements must be met:

1. The statement must be false.

2. The statement must be published (communicated to a third party).

3. The publisher must have acted negligently or with intent to harm.
