How Long Do Court Cases Take in Colorado Springs, Colorado

When you find yourself entangled in a legal dispute, one of the most pressing questions on your mind is likely, “How long will this take?” Understanding the timeline of court cases in Colorado Springs, Colorado, is crucial for planning your next steps, managing your expectations, and mitigating stress. The duration of a court case can vary significantly depending on several factors, including the type of case, the complexity of the legal issues involved, the court’s schedule, and the preparedness of both parties.

Understanding the Court System in Colorado Springs

Colorado Springs falls within the Fourth Judicial District of Colorado, which encompasses El Paso and Teller Counties. The district court handles major civil cases, criminal cases, probate, domestic relations, and juvenile cases. Meanwhile, the county courts address misdemeanor cases, traffic infractions, civil cases under $25,000, and small claims.

Each type of case follows a different procedural path, impacting the overall timeline from filing to resolution. To provide a more comprehensive understanding, let’s delve into the specific timelines associated with various types of court cases.

Civil Cases

Colorado Springs Civil Litigation AttorneyCivil litigation involves disputes between individuals or entities over legal duties and responsibilities they owe to each other. These cases can include personal injury claims, contract disputes, property disputes, and more.

  1. Pre-Filing Stage: Before a lawsuit is formally filed, there is often a pre-filing stage where the parties attempt to resolve the dispute through negotiations or alternative dispute resolution methods like mediation. This stage can last anywhere from a few weeks to several months, depending on the complexity of the case and the willingness of the parties to settle.
  2. Filing and Service: Once a complaint is filed, the defendant must be served with the legal documents. This process typically takes a few weeks but can be extended if the defendant is difficult to locate.
  3. Response and Discovery: After the defendant is served, they have a specific period to respond to the complaint, which in Colorado is 21 days, as per C.R.C.P. Rule 12. Following this, both parties engage in the discovery process, where they exchange information, documents, and take depositions. Discovery can last several months to a year or more, depending on the complexity of the case and the amount of information involved.
  4. Pre-Trial Motions and Settlement Discussions: Before the trial, parties may file various motions to resolve certain issues or dismiss parts of the case. Settlement discussions or mediation may also occur during this period. This phase can last several months.
  5. Trial: If the case does not settle, it proceeds to trial. The trial itself can last anywhere from a few days to several weeks, depending on the number of witnesses and the complexity of the evidence.
  6. Post-Trial Motions and Appeals: After the trial, the losing party may file post-trial motions or appeal the decision, adding additional months or even years to the case timeline.

Criminal Cases

Criminal cases in Colorado Springs follow a different trajectory and are typically faster than civil cases due to the constitutional right to a speedy trial. However, the duration still varies based on the severity of the charges and the specifics of the case.

  1. Arrest and Initial Hearing: After an arrest, the defendant is brought before a judge for an initial hearing, usually within 48 hours.
  2. Preliminary Hearing or Grand Jury: For felony cases, a preliminary hearing or grand jury is conducted to determine if there is sufficient evidence to proceed. This step typically occurs within a few weeks of the initial hearing.
  3. Arraignment: The defendant is formally charged and enters a plea. This generally happens within 30 days of the preliminary hearing.
  4. Discovery and Pre-Trial Motions: Similar to civil cases, there is a discovery phase, followed by pre-trial motions. This phase can last several months.
  5. Trial: Misdemeanor trials are usually quicker, often taking a few days to a week. Felony trials, especially those involving serious charges, can last several weeks.
  6. Sentencing and Appeals: If convicted, sentencing typically occurs within a few weeks of the trial. The defendant may also appeal the conviction, extending the case duration.

Family Law Cases

Family law cases, including divorce, child custody, and support cases, also have variable timelines.

  1. Filing and Service: Similar to civil cases, the filing and serving of divorce or custody petitions can take a few weeks.
  2. Temporary Orders: Courts often issue temporary orders for custody, support, and property during the divorce process. This can occur within a few weeks to months of filing.
  3. Discovery and Negotiations: The discovery phase allows both parties to gather information and negotiate settlements. This phase can last several months to over a year.
  4. Mediation and Settlement: Many family law cases settle through mediation, which can take several months.
  5. Trial: If the case goes to trial, it can take several days to weeks, depending on the issues involved.

Factors Affecting Case Duration

Several factors can influence the duration of a court case in Colorado Springs, including:

  • Complexity of the Case: More complex cases with numerous witnesses, extensive evidence, and complicated legal issues take longer to resolve.
  • Court Schedules: The availability of judges and courtrooms can cause delays. Courts with heavy caseloads may have longer wait times for hearings and trials.
  • Parties’ Cooperation: Cases where both parties are cooperative and willing to negotiate or settle tend to resolve more quickly.
  • Legal Representation: Experienced attorneys can navigate the legal system more efficiently, potentially shortening the case duration.

I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
