How to Become a Legal Guardian for a Minor in Colorado

Becoming a legal guardian for a minor in Colorado is a significant responsibility that requires navigating a complex legal process. Legal guardianship is established to ensure the well-being and care of minors whose parents are unable to fulfill their parental duties. At Baker Law Group, we are dedicated to providing comprehensive legal support to help you through every step of the guardianship process.

Understanding Legal Guardianship for Minors in Colorado

Legal guardianship grants an individual the authority to make decisions and care for a minor child. This arrangement is essential when the child’s parents are unable to provide the necessary care due to various reasons, such as illness, incapacity, or other challenging circumstances. Guardianship ensures that the child’s best interests are protected and that they receive the care and support they need.

Types of Guardianship

In Colorado, there are several types of guardianship for minors:

  1. Permanent Guardianship: This is a long-term arrangement where the guardian has ongoing responsibility for the minor until they reach adulthood.
  2. Temporary Guardianship: This type of guardianship is granted for a specific period, often in emergency situations or when the parents are temporarily unable to care for the child.
  3. Limited Guardianship: The guardian is given specific, limited authority over certain aspects of the minor’s life, as determined by the court.

Steps to Become a Legal Guardian for a Minor in Colorado

The process of becoming a legal guardian for a minor involves several key steps, each requiring careful attention to detail and adherence to legal procedures.

  1. Determine the Need for Guardianship

The first step is to assess whether guardianship is necessary. This involves evaluating the current situation and understanding why the parents are unable to care for the child. Common reasons for seeking guardianship include parental illness, incapacity, abandonment, or other situations where the child’s welfare is at risk.

  1. Gather Necessary Documentation

To support your petition for guardianship, you will need to gather various documents, including:

  • Birth certificates of the minor
  • Medical records (if relevant)
  • Financial records
  • Any existing legal documents, such as previous custody arrangements
  1. File a Petition for Guardianship

The next step is to file a petition for guardianship with the appropriate Colorado court. As per C.R.S. 15-14-304, the petition must include detailed information about the minor, the reasons for seeking guardianship, and the proposed guardian’s qualifications. It’s essential to provide as much detail as possible to support your case.

  1. Notify Interested Parties

Colorado law requires that all interested parties be notified of the guardianship petition. This includes the minor’s parents, close family members, and any other individuals who have a significant relationship with the child. Proper notice allows these parties to raise any objections if they wish.

  1. Court Investigation and Home Study

Once the petition is filed, the court may order an investigation or home study to evaluate the proposed guardian’s suitability. This process involves interviews, home visits, and reviews of relevant documents to ensure that the guardian can provide a safe and stable environment for the minor.

  1. Attend the Court Hearing

A court hearing will be scheduled where the judge will review the petition, the investigator’s report, and any objections from interested parties. During the hearing, you will have the opportunity to present your case and demonstrate why guardianship is in the best interest of the minor.

  1. Obtain the Guardianship Order

If the judge approves the petition, a guardianship order will be issued. This legal document grants you the authority to decide and care for the minor. The order outlines your responsibilities and any limitations on your authority as a guardian.

  1. Comply with Ongoing Requirements

Once guardianship is established, you must comply with any ongoing requirements set by the court. This may include submitting periodic reports on the minor’s well-being and providing updates on their care and living situation. Failure to comply with these requirements can result in the termination of the guardianship.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
