How to File a Civil Suit for Real Estate Fraud

Real estate fraud can be a devastating experience, causing significant financial loss and emotional distress. If you believe you have been a victim of real estate fraud, it is crucial to take swift and informed action to protect your interests.

This comprehensive guide by Baker Law Group will walk you through the process of filing a civil suit for real estate fraud in Colorado, ensuring you understand your rights and the steps you need to take.

Understanding Real Estate Fraud

Real estate fraud occurs when someone uses false information, deceit, or misrepresentation to gain an unfair advantage in a real estate transaction. Common types of real estate fraud include:

  • Mortgage Fraud: Providing false information to obtain a mortgage loan.
  • Title Fraud: Forging documents to claim ownership of a property.
  • Foreclosure Fraud: Misleading homeowners into signing away their property rights.
  • Real Estate Investment Scams: Promising high returns on property investments that do not exist.

Colorado Civil Litigation AttorneySteps to Take Before Filing a Civil Suit

Before filing a civil suit for real estate fraud, there are several critical steps you should take:

  1. Gather Evidence

Collect all relevant documents and evidence related to the fraudulent transaction. This may include:

  • Contracts and Agreements: Any signed documents between you and the other party.
  • Communication Records: Emails, letters, and messages that demonstrate fraudulent activity.
  • Financial Records: Bank statements, payment receipts, and loan documents.
  • Property Records: Title deeds, property appraisals, and inspection reports.
  1. Consult a Real Estate Attorney

Consulting an experienced real estate attorney is essential. An attorney can help you understand your legal options, evaluate the strength of your case, and guide you through the legal process. Baker Law Group has a team of skilled attorneys who can assist you with your real estate fraud case.

  1. Report the Fraud

Report the fraud to the appropriate authorities. In Colorado, you can file a complaint with the Colorado Attorney General’s Office or the Colorado Division of Real Estate. Reporting the fraud can help prevent others from becoming victims and may support your civil suit.

Filing a Civil Suit for Real Estate Fraud

Once you have gathered evidence and consulted with an attorney, you can proceed with filing a civil suit for real estate fraud. Here are the steps involved:

  1. Drafting the Complaint

The complaint is a legal document that initiates the lawsuit. It outlines your allegations, the facts of the case, and the legal basis for your claim. Your attorney will help you draft a detailed and compelling complaint that includes:

  • Parties Involved: Names and contact information of the plaintiff (you) and the defendant (the alleged fraudster).
  • Facts of the Case: A detailed account of the fraudulent transaction, including dates, locations, and actions taken by the defendant.
  • Legal Claims: Specific legal grounds for your lawsuit, such as fraud, misrepresentation, or breach of contract.
  • Relief Sought: The compensation or remedy you are seeking, such as monetary damages or rescission of the fraudulent transaction.
  1. Filing the Complaint

File the complaint with the appropriate court. In Colorado, civil suits for real estate fraud are typically filed in the District Court of the county where the property is located or where the defendant resides. Your attorney will ensure that the complaint is filed correctly and in a timely manner.

  1. Serving the Defendant

After filing the complaint, you must serve a copy to the defendant. Proper service of process ensures that the defendant is formally notified of the lawsuit. This can be done through:

  • Personal Service: Delivering the complaint in person.
  • Certified Mail: Sending the complaint via certified mail with return receipt requested.
  • Process Server: Hiring a professional process server to deliver the complaint.
  1. Awaiting the Defendant’s Response

In Colorado, the defendant has 21 days in Colorado to respond to the complaint, as per C.R.C.P. 121. They can file an answer, admitting or denying the allegations, or file a motion to dismiss the case. Your attorney will handle any responses from the defendant and prepare for the next steps in the litigation process.

  1. Discovery Process

The discovery process allows both parties to gather additional evidence and information about the case. This may include:

  • Interrogatories: Written questions that must be answered under oath.
  • Depositions: Oral testimony given under oath and recorded for use in court.
  • Requests for Production: Requests for specific documents or evidence.
  • Requests for Admissions: Requests for the other party to admit or deny certain facts.
  1. Settlement Negotiations

Before the case goes to trial, there may be opportunities for settlement negotiations. Settlement can save time and legal expenses. Your attorney will negotiate on your behalf to achieve a fair and favorable resolution. If a settlement is not reached, the case will proceed to trial.

Trial and Judgment

If your case goes to trial, both parties will present their evidence and arguments before a judge or jury. The judge or jury will then decide the outcome based on the evidence presented. If you win the case, the court may award you monetary damages, order the rescission of the fraudulent transaction, or provide other relief.

Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
