How to Protect Your Property from Unjustified Mechanics Liens in Colorado

Facing unjustified mechanics’ liens can cause significant stress for property owners in Colorado. A mechanics lien in Colorado a legal claim filed by contractors, subcontractors, or suppliers against a property when they haven’t been paid for labor, materials, or services provided for construction or improvements. This lien secures their right to payment and can result in foreclosure on the property if the debt remains unpaid.

These liens, meant to secure payment for contractors and suppliers, sometimes end up improperly filed against properties, leaving owners unfairly responsible. Understanding unjustified mechanics’ liens in Colorado helps property owners safeguard their rights and finances.

This guide provides practical information on preventing and resolving unjustified mechanics liens. At Baker Law Group, PLLC, our experienced team of mechanics’ lien attorneys helps property owners protect their real estate assets from incorrect or unfair lien claims. With responsiveness and strategic advice, our attorneys deliver results when it matters most.

What Are Unjustified Mechanics Liens in Colorado?

Mechanics’ liens in Colorado serve a legitimate purpose—ensuring contractors, subcontractors, and suppliers receive payment for labor or materials provided to improve a property. However, an unjustified mechanics lien arises when someone incorrectly or unfairly claims the right to place a lien against your property. Such liens can arise from misunderstandings, billing disputes, or intentional misuse.

Unjustified mechanics’ liens negatively impact property owners, making it difficult for them to refinance, sell, or transfer ownership of their property until the lien is resolved. Therefore, proactively preventing or resolving these liens is essential.

Recognize Situations That Lead to Unjustified Mechanics Liens

Certain situations commonly result in unjustified mechanics‘ liens in the state of Colorado. Being aware of these circumstances helps property owners stay informed and avoid unnecessary legal complications.

Payment Disagreements

Disputes about the cost or quality of work are frequent triggers of unjustified mechanics liens. A contractor might file a lien prematurely if disagreements arise over billing or project expectations, even if the property owner has paid fairly or on time.

Contractor and Subcontractor Conflicts

Sometimes, subcontractors file liens against the property if the general contractor hasn’t properly distributed payments. Even if you paid your general contractor in full, you could face an unjustified lien because of internal disputes.

Administrative Errors

Simple errors, such as incorrect filing procedures, missing deadlines, or incomplete documentation, can also cause unjustified mechanics liens. Contractors unfamiliar with Colorado mechanics lien laws may mistakenly file invalid liens against property owners.

Fraudulent Claims

Rarely, contractors or suppliers may knowingly file fraudulent liens as a leverage or intimidation tactic. Although these claims are uncommon, they represent a serious misuse of the mechanics lien process and require prompt legal intervention.

Preventing Unjustified Mechanics Liens on Your Colorado Property

Taking proactive steps significantly reduces the risk of unjustified mechanics’ liens. Colorado property owners can employ effective strategies to safeguard their real estate investments.

Request Lien Waivers Regularly

A lien waiver is a signed statement from your contractor or subcontractor, declaring they have received payment and waive the right to file future liens against your property, and requesting these waivers after each payment protects you by creating a clear payment trail.

Maintain Detailed Payment Records

Thorough records, including invoices, receipts, canceled checks, and bank statements, provide strong evidence if unjustified mechanics liens are filed. Proper documentation demonstrates timely payment and compliance with contractual obligations.

Verify Contractor and Supplier Credentials

Hiring reputable, licensed contractors reduces risks associated with unjustified mechanics’ liens. Verify licenses, insurance, and past customer experiences before accepting a job. Reliable contractors follow proper filing procedures, minimizing misunderstandings.

Include Protective Clauses in Contracts

Written contracts should clearly outline payment schedules, completion standards, dispute resolution methods, and lien waiver obligations. Detailed contracts reduce ambiguity and clarify expectations, preventing unnecessary lien filings.

Resolving Unjustified Mechanics Liens in Colorado Effectively

When unjustified mechanics’ liens occur, timely and strategic action is essential to minimize financial and legal consequences. Property owners have several options available to address incorrect liens efficiently.

Send a Notice of Intent to Contest

Colorado law allows property owners to respond promptly by sending the lien claimant a Notice of Intent to Contest within a specific timeframe. Filing this notice can compel the lienholder to prove their claim in court or withdraw it if it is unjustified.

Filing a Bond to Remove Liens

In certain situations, property owners may file a surety bond with the Colorado court to expedite the discharge of the lien. This bond replaces the property as security, removing the lien from the property’s title, which frees the property for sale or refinancing while disputes are resolved.

Initiating Legal Action to Remove Invalid Liens

Legal action becomes necessary if the lien claimant refuses to withdraw an unjustified lien voluntarily. Filing a lawsuit allows the court to review evidence and determine the validity of the lien claim. Successful legal action can permanently remove the lien and potentially award the property owner legal fees.

Important Colorado Mechanics Lien Deadlines and Rules

Colorado law includes strict deadlines governing the mechanics lien process, and understanding these timelines can help you prevent unjustified mechanics liens.unjustified mechanics lien in colorado

  • Contractors must typically file mechanics’ liens within four months after their last labor or material delivery.
  • Property owners have the right to contest a mechanics lien by providing the Notice of Intent to Contest within a specific timeframe.
  • Contractors or suppliers filing liens must adhere to strict procedural requirements; failure to comply can render the lien invalid.

Awareness of these deadlines ensures prompt action, limiting the impact of unjustified liens.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
