Understanding the Role of a Guardian Ad Litem in Colorado

In child custody disputes and other family law matters involving children, Colorado courts may appoint a Guardian ad Litem (GAL). Understanding the function and responsibilities of a GAL can be essential in preparing for your case and knowing how decisions about your child’s future will be made. At Baker Law Group, PLLC, our family law attorneys are committed to comprehensive legal support. Understanding the role of a Guardian ad Litem is a key part of this process.

What Is a Guardian ad Litem?

A Guardian ad Litem (GAL) is a court-appointed representative who investigates and advocates for the best interests of a child in a legal dispute. This may include a family law case such as divorce, child custody, or abuse and neglect proceedings. Unlike a parent or legal guardian, a GAL focuses solely on what is best for the child. In Colorado, the GAL is often a licensed attorney with specialized training in child advocacy. The appointment of a Guardian ad Litem is governed by Colorado law, specifically under Colorado Revised Statutes § 14-10-116, which outlines the responsibilities and authority of a GAL in child custody and other family law matters.

Role and Duties of a Guardian ad Litem

The GAL’s primary role is to advocate for the child’s best interests, and their responsibilities are specified by Colorado law. A Guardian ad Litem has several key duties in child custody cases:

Investigating the Child’s Situation

One of the primary duties of a GAL is to conduct a thorough investigation of the child’s living situation, family dynamics, and overall environment. This typically includes:

  • Visiting the child’s home and the homes of the parents to assess living conditions.
  • Interviewing the child, parents, caregivers, teachers, and other relevant individuals to gather information about the child’s needs and well-being.
  • Reviewing medical records, school records, and any other pertinent documents related to the child’s health, education, and welfare.

Advocating for the Child’s Best Interests

The GAL’s role is to advocate for the best interests of the child, which may involve:

  • Making recommendations to the court regarding custody arrangements, visitation schedules, and additional services such as counseling or therapeutic support.
  • Representing the child’s views and ensuring their preferences are communicated to the court, particularly if the child is old enough to express them.

Preparing Reports for the Court

The GAL is responsible for preparing detailed reports summarizing their findings and recommendations. These reports are submitted to the court and can influence the final custody decision. The report may include findings from home visits, interviews, and document reviews, along with recommendations for custody arrangements, visitation schedules, and any other relevant issues, as well as observations on the child’s behavior, interactions with parents, and overall well-being. It is important to note that while the GAL’s recommendations carry significant weight, the final decision on all matters lies with the judge.

Participating in Court Hearings

The GAL may attend court hearings and provide testimony based on their investigation and recommendations. Their presence in court is intended to provide an unbiased perspective on what is best for the child.

The GAL’s Relationship with the Child

In Colorado, the GAL also serves as the child’s legal representative. This means they have an attorney-client relationship with the child and must respect and uphold the associated confidentiality. The GAL explains the court process to the child in an age-appropriate manner and considers the child’s wishes when making recommendations to the court.

The Impact of a Guardian ad Litem on Child Custody Cases

The involvement of a Guardian ad Litem can significantly impact the outcome of a child custody case in several ways:

  • Providing an objective perspective: The GAL offers an independent viewpoint on the child’s situation, separate from the interests and biases of the parents, helping the court make decisions based on the child’s best interests.
  • Influencing custody decisions: The GAL’s recommendations, as presented in their reports and testimony, can greatly influence the court’s custody decisions.
  • Facilitating communication: The GAL can help clarify issues and suggest solutions that focus on the child’s well-being, which can lead to more effective co-parenting arrangements and reduce conflicts.
  • Highlighting concerns: If there are concerns about a parent’s ability to provide a safe and supportive environment, the GAL can bring these to the court’s attention, particularly in cases involving abuse, neglect, or other serious issues.

How to Interact with a Guardian ad Litem

If a GAL is appointed to your case, cooperation is key. While it may feel intimidating, remember that the GAL is there to protect your child’s interests, not to judge your parenting. Here are some steps to take:

  • Be transparent and cooperative. Provide the GAL with honest and accurate information about your living situation, parenting abilities, and any other relevant aspects. Cooperation and transparency can help build trust and ensure that the GAL has a clear understanding of the situation.
  • Prepare for interviews. Be ready to discuss your parenting plan, your child’s needs, and any concerns you may have. Be open to answering questions and providing documentation as requested.
  • Follow court orders. Adhere to any court orders or recommendations made by the GAL. Demonstrating compliance and being proactive in addressing any concerns can positively influence the GAL’s recommendations.
  • Seek legal advice. Consult with an experienced family law attorney to ensure that you understand your rights and responsibilities in relation to the GAL’s involvement.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
