What Are the Most Common Misdemeanors in Denver

Misdemeanors are criminal offenses that, while less severe than felonies, can still carry significant consequences. In Denver, these offenses often involve violations of state and local laws, including property crimes, public order offenses, and traffic violations. Understanding the most common misdemeanors in Denver can help residents avoid legal trouble and be aware of their rights if accused. Baker Law Group is here to provide insight into these offenses and how to handle them.

Common Types of Misdemeanors in Denver

  1. Traffic Offenses

Denver criminal lawyerTraffic-related misdemeanors are among the most frequently charged offenses in Denver. These include:

  • Driving Under the Influence (DUI): Operating a vehicle while impaired by alcohol or drugs can lead to a misdemeanor charge, with penalties including fines, license suspension, and potential jail time.
  • Reckless Driving: Driving with willful disregard for the safety of others is a serious misdemeanor with substantial fines and points added to a driver’s license.
  • Driving Without a Valid License or Insurance: Being caught without proper documentation can result in misdemeanor charges.
  1. Theft

Theft offenses in Denver are often classified as misdemeanors if the value of the stolen property falls below $2,000. Common examples include:

  • Shoplifting: Taking items from a retail store without paying.
  • Petty Theft: Stealing low-value items, such as a wallet or a bicycle.

Penalties for misdemeanor theft typically include fines, restitution to the victim, and potentially probation or jail time.

  1. Drug Possession

Possession of small amounts of controlled substances, such as marijuana exceeding legal limits or unauthorized prescription drugs, often results in misdemeanor charges. Although Colorado has legalized recreational marijuana, possessing more than the legal limit or consuming it in public can lead to legal repercussions.

  1. Assault

Simple assault, or causing bodily harm to another person without a deadly weapon, is frequently charged as a misdemeanor in Denver. These cases often arise from heated arguments or physical altercations and can escalate to more serious charges if aggravating factors are present.

  1. Disorderly Conduct

Disorderly conduct encompasses a wide range of behaviors that disrupt public peace or safety. Examples include:

  • Public intoxication.
  • Fighting or challenging someone to fight in public.
  • Making unreasonable noise in a residential area.

While these offenses might seem minor, they can lead to fines, community service, or even jail time.

  1. Domestic Violence

Certain acts of domestic violence, such as harassment or minor physical altercations between intimate partners or family members, are charged as misdemeanors. Colorado takes domestic violence cases seriously, often requiring mandatory counseling and imposing no-contact orders during the legal process.

  1. Trespassing

Trespassing involves unlawfully entering or remaining on someone else’s property. In Denver, this can range from being on private property without permission to refusing to leave a business after being asked.

  1. Vandalism

Acts of vandalism, such as graffiti or damaging another person’s property, are commonly charged as misdemeanors if the damage is minimal. These charges often require the offender to pay restitution or complete community service.

Potential Consequences of Misdemeanors in Denver

While misdemeanors are less severe than felonies, they still carry significant consequences that can affect your life. Penalties for misdemeanors in Denver may include:

  • Fines: Depending on the offense, fines can range from a few hundred dollars to several thousand.
  • Jail Time: Misdemeanor convictions can lead to jail sentences of up to 364 days in county jail.
  • Probation: Offenders may be required to comply with probation terms, including regular check-ins, counseling, and community service.
  • Criminal Record: A misdemeanor conviction can remain on your record, impacting future employment, housing, and educational opportunities.

It is crucial to handle misdemeanor charges carefully to minimize their impact on your life. Legal representation can play a key role in achieving the best possible outcome.

How to Defend Against Misdemeanor Charges in Denver

If you are accused of a misdemeanor in Denver, it is essential to understand your rights and options. Defenses vary depending on the type of misdemeanor but may include:

  • Challenging Evidence: Questioning the legality of the evidence or its collection (e.g., unlawful search and seizure).
  • Self-Defense: In cases of assault or similar charges, proving you acted to protect yourself or others.
  • Mistaken Identity: Demonstrating that you were not the individual responsible for the offense.
  • Negotiating Plea Deals: Sometimes, charges can be reduced or dismissed through negotiation.

Seeking advice from an experienced Denver criminal lawyer can help you navigate these defenses effectively.

Why Legal Representation Matters

Even for seemingly minor offenses, a misdemeanor conviction can have lasting consequences. Hiring a lawyer ensures that your case is thoroughly reviewed and your rights are protected. An attorney can negotiate with prosecutors, gather evidence to support your defense, and advocate for reduced penalties or case dismissal.

Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
