What Are the Three Types of Misdemeanors in Colorado?

In Colorado, criminal offenses are classified based on severity, with misdemeanors falling between petty offenses and felonies. While misdemeanors may not carry penalties as severe as felony charges, convictions can still significantly impact your personal life, career opportunities, and future prospects. Understanding Colorado’s misdemeanor classifications and associated penalties is critical for anyone charged with a misdemeanor in Denver.

Colorado divides misdemeanors into three categories: Class 1 misdemeanors, Class 2 misdemeanors, and unclassified misdemeanors. Each class has specific criteria and sentencing guidelines. Baker Law Group is committed to providing clear guidance about misdemeanors in Denver, enabling clients to navigate their legal situations effectively.

Below, we’ll explain each misdemeanor type, typical examples, potential penalties, and how a skilled Denver misdemeanor lawyer can help you if you’re facing charges.

Class 1 Misdemeanors in Colorado

Class 1 misdemeanors are the most serious offenses under Colorado law. Due to their gravity, penalties for conviction can be substantial, and prosecutors often aggressively pursue Class 1 misdemeanor charges.

Common Examples of Class 1 Misdemeanors

  • Third-degree assault: Causing physical injury intentionally, knowingly, or recklessly.
  • Theft (valued between $750 and $2,000): Taking property without consent within specified values.
  • Criminal mischief: Damage to property where losses range between $1,000 and $2,000.
  • Driving Under Restraint (DUR): Operating a vehicle while your driver’s license is suspended or revoked.

Penalties for Class 1 MisdemeanorsDenver misdemeanor lawyer

Colorado courts may impose the following penalties upon conviction of a Class 1 misdemeanor:

  • Up to 364 days in jail
  • Fines ranging from $500 to $1,000, depending on the offense
  • Probation, community service, and mandatory counseling or rehabilitation programs
  • Possible restitution to victims, particularly in property or theft-related offenses

Given the potentially severe penalties and lasting criminal records, individuals charged with Class 1 misdemeanors should consult with an experienced attorney immediately.

Class 2 Misdemeanors in Colorado

Class 2 misdemeanors in Colorado include offenses less severe than Class 1 but still serious enough to warrant considerable penalties. Convictions can result in significant disruptions to your personal and professional life.

Common Examples of Class 2 Misdemeanors

  • Second-degree criminal trespass: Entering or unlawfully remaining on someone else’s property.
  • Certain harassment offenses: Including threats or repeated communications intended to disturb another person.
  • Theft (valued between $300 and $750): Unauthorized taking of property within this lower value range.
  • Resisting arrest: Obstructing police officers while they are lawfully performing their duties.

Penalties for Class 2 Misdemeanors

If convicted of a Class 2 misdemeanor in Colorado, you may face:

  • Up to 120 days in jail
  • Fines up to $750
  • Probation periods, community service, and court-ordered educational programs
  • Potential restitution payments to victims

Although penalties for Class 2 misdemeanors are less severe than Class 1, a conviction can still create long-term personal and financial burdens. Representation by a knowledgeable Denver misdemeanor lawyer can help you minimize the consequences or even avoid conviction.

Unclassified Misdemeanors in Colorado

Colorado law also recognizes certain misdemeanors as “unclassified.” Unclassified misdemeanors don’t fall neatly into Class 1 or Class 2 categories and typically have specific penalties clearly outlined in the statutes defining the offenses. While these misdemeanors vary in severity, penalties can still significantly impact your life.

Common Examples of Unclassified Misdemeanors

  • Driving Under the Influence (DUI) or Driving While Ability Impaired (DWAI): These serious traffic misdemeanors carry mandatory sentencing guidelines.
  • Certain traffic offenses, including reckless and careless driving, result in bodily injury.
  • Possession of drug paraphernalia: Possessing instruments or tools used for drug consumption.

Penalties for Unclassified Misdemeanors

Penalties for unclassified misdemeanors differ depending on the specific offense and circumstances. For instance, DUI offenses may carry mandatory jail sentences, extensive fines, license suspensions, and mandatory alcohol education classes. Reckless driving could include fines and points assessed against your license, potentially resulting in suspension or revocation.

Given the nuanced nature of unclassified misdemeanors, consulting a criminal defense lawyer is crucial to understanding potential outcomes and developing an effective defense strategy.

Consequences Beyond Court Penalties

Regardless of the misdemeanor class, convictions can carry consequences far beyond immediate penalties such as fines or jail time. Long-term consequences include:

  • Permanent criminal record: Affecting employment opportunities, housing, education, and professional licenses.
  • Background checks: Misdemeanors appear in routine background checks, negatively influencing prospective employers or landlords.
  • Immigration impacts: Non-citizens may experience adverse consequences, including possible deportation or visa complications.

Hiring a skilled misdemeanor attorney can help mitigate these broader impacts by working to reduce charges or pursue alternative sentencing options like diversion programs or deferred judgments.

Defenses Against Misdemeanor Charges

An experienced Denver misdemeanor lawyer from Baker Law Group can explore various defense strategies depending on your specific charges, including:

  • Challenging improper police conduct or constitutional violations
  • Disputing eyewitness testimony or the credibility of evidence
  • Negotiating plea agreements to minimize penalties
  • Advocating for alternative sentencing programs such as diversion or deferred judgment, enabling you to avoid convictions altogether, potentially

Early intervention by an attorney significantly increases the likelihood of a favorable outcome.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
