What Drugs Are Decriminalized in Denver?

In recent years, Denver has been at the forefront of significant legal reforms regarding drug possession and usage. Colorado’s capital city has enacted landmark policies that decriminalize certain substances, reflecting a broader shift toward public health-oriented drug policies rather than strictly punitive measures. Understanding precisely which drugs are decriminalized in Denver—and the scope of these legal changes—is crucial for residents and visitors alike.

At Baker Law Group, our experienced criminal defense attorneys in Denver stay informed about these shifting legal landscapes to provide our clients with clear, accurate, and timely guidance. This blog will clarify which substances have been decriminalized, how Denver’s laws differ from broader state and federal regulations, and what this means for individuals within the city limits.

Denver’s Decriminalization of Psilocybin Mushrooms

In 2019, Denver became the first U.S. city to decriminalize psilocybin mushrooms, commonly known as magic mushrooms. The passage of Initiated Ordinance 301 marked a significant turning point in local drug policy. It is important to note that “decriminalization” does not equal legalization. Rather, Denver’s ordinance made enforcing psilocybin-related offenses the lowest priority for local law enforcement.

The ordinance specifies that adults aged 21 and older possessing psilocybin mushrooms for personal use are not actively prosecuted at the local level. However, buying, selling, or distributing these substances remains illegal and prosecutable. Moreover, since psilocybin remains a Schedule I controlled substance at both the state and federal levels, law enforcement at those jurisdictions could still prosecute offenders. Thus, understanding the limits of this decriminalization is crucial.

Understanding the Difference Between Decriminalization and Legalization

To clarify common misconceptions, it’s essential to distinguish between “decriminalization” and “legalization”:

  • Decriminalization means that the substance remains technically illegal, but local authorities have chosen not to prosecute small-scale personal possession cases actively.
  • Legalization means the substance is fully legal and regulated similarly to alcohol or cannabis in Colorado.

In Denver’s case, psilocybin mushrooms remain illegal but are effectively de-prioritized, reducing the immediate threat of criminal penalties for simple possession.

Denver’s Broader Approach to Drug Policy Reform

In addition to psilocybin mushrooms, Denver’s evolving stance on drug policy reflects a broader trend toward harm reduction and public health strategies. While psilocybin is currently the only specific drug officially decriminalized, city officials and advocacy groups continue to debate extending decrimi

nalization to other naturally occurring psychedelics, such as ayahuasca, ibogaine, and mescaline (excluding peyote, due to cultural sensitivities).

As of now, no other psychedelics or controlled substances have been officially decriminalized within Denver’s city limits. Possession of other drugs, including cocaine, methamphetamine, heroin, and opioids, continues to be prosecuted aggressively.

Cannabis: Legalized and Regulated

Cannabis is an important exception to this discussion. Colorado voters legalized recreational cannabis statewide in 2012 with Amendment 64, making Denver one of the first major U.S. cities to embrace regulated marijuana sales and possession. Adults aged 21 or older can legally purchase, possess, and consume cannabis within established limits:

  • Possession of up to one ounce (28 grams) of cannabis is legal.
  • Growing up to six marijuana plants privately, with no more than three plants mature at a time, is legal.

However, possessing amounts beyond these limits or attempting to distribute cannabis without proper licensing remains criminally prosecutable.

Potential Legal Consequences and Enforcement Realities

Even with Denver’s groundbreaking drug policies, residents must remain cautious. Federal drug laws continue to classify substances like psilocybin and cannabis as illegal under the Controlled Substances Act, regardless of state or local statutes. This means federal law enforcement, including the Drug Enforcement Administration (DEA), retains the authority to enforce federal laws against drug possession or distribution, although federal agencies rarely target individual users.

Additionally, crossing Denver city boundaries into other jurisdictions, even within Colorado, significantly changes the legal framework. Possession of decriminalized substances outside city limits could lead to severe criminal penalties. Residents and visitors should remain aware of these jurisdictional boundaries and differing laws.

Advocacy for Future Decriminalization

Denver continues to serve as a testing ground for drug policy reform nationally. Advocates push for further decriminalization or even legalization of additional substances, pointing to potential benefits such as reduced incarceration rates, harm reduction, mental health treatment, and therapeutic uses for certain psychedelics.

Local political discussions and ballot initiatives could see Denver expanding its decriminalization efforts. Baker Law Group closely follows these developments to provide timely, informed defense strategies for clients navigating the evolving legal landscape.

Why Seek Legal Advice Regarding Denver’s Drug Laws?

Even with these legal reforms, misunderstandings or misapplications of laws by law enforcement still occur. Knowing precisely what is decriminalized—and to what extent—can help prevent unnecessary legal troubles. If you or someone you know faces charges or legal complications involving drugs, whether psilocybin, cannabis, or other controlled substances, professional legal representation remains critical.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
