Who Is Eligible to Have Their Criminal Records Sealed in Colorado?

Navigating the legal landscape after conviction is very difficult. A conviction can affect many parts of your life, but there is still hope in the form of sealing records. This will prevent the record from hampering you during a job interview, securing a loan, or purchasing a weapon. Individuals seeking to seal their criminal records must understand the specific criteria set forth by Colorado law, as these regulations define who is eligible for this legal relief. This article is a clear and insightful guide to get your life back on track after a conviction.

Understanding the Basics of Record Sealing in Colorado

Record sealing is a legal process that restricts public access to certain criminal records. In Colorado, this is not an erasure of records but rather a concealment from public view, meaning the records still exist but are not accessible through standard background checks. This process is vital for individuals seeking a fresh start, as sealed records can significantly impact one’s ability to secure employment, housing, and educational opportunities.

Eligibility Criteria for Record Sealing

The eligibility to have criminal records sealed in Colorado largely depends on the nature of the offense, the final disposition of the case, and the time elapsed since the case was closed. It’s important to note that not all records can be sealed. Here are key points that determine eligibility:

1. Nature of the Offense

  • Drug Offenses: Certain drug offenses, especially those that have been decriminalized or have had their penalties reduced, may be eligible for sealing.
  • Petty Offenses: These are often eligible for sealing, provided specific conditions are met.
  • Juvenile Records: Generally, juvenile records are easier to seal, reflecting the state’s intention to allow minors to outgrow their past mistakes.

2. Final Disposition of the Case

Acquittal or Dismissal: If the charges were dropped or if you were acquitted, you might be eligible to have your records sealed.

3. Waiting Period

Colorado law stipulates waiting periods post-final disposition before you can apply to seal your records. The length of the waiting period can vary based on the severity of the offense and the specific circumstances of your case.

The Record Sealing Process in Colorado

Understanding the procedure for sealing records in Colorado is crucial. The process generally involves:

  • Eligibility Assessment: Reviewing the specific details of your case to ensure eligibility.
Criminal History Report: Have a verified copy of your criminal history. You must file it no more than 10 days after filing the motion to seal
  • Petition Filing: Preparing and filing a petition for sealing records, including relevant documents and evidence.
  • Filing Petition: Once the petition is complete, you must pay and file the court fee.
  • Judge’s Decision: If the judge approves your petition, an order will be issued to seal your records.
  • Court Hearing: A hearing is often required, during which the judge will consider your petition along with any objections.

Challenges in Sealing Records

While the opportunity to seal criminal records offers a pathway to a clearer future, it’s not without challenges. The process is legally complex and can be daunting without proper legal guidance. Factors such as the nature of your offense, the details of your case, and the specific requirements of the local jurisdiction can all influence the outcome of your petition.

Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
