Can You Sue for Breach of Confidentiality in Denver, Colorado

Confidentiality is a cornerstone of trust in many personal, professional, or medical relationships. When this trust is breached, it can lead to significant emotional, financial, and reputational harm.

If you believe someone has breached confidentiality, you may wonder if you can take legal action. In Denver, Colorado, legal avenues are available to sue for breach of confidentiality. This guide, provided by Baker Law Group, will help you understand your options and the steps involved in pursuing a legal claim.

Understanding Breach of Confidentiality

A breach of confidentiality occurs when someone discloses private information without permission. This can happen in various contexts, including:

  1. Medical: A healthcare provider shares patient information without consent.
  2. Professional: An employee discloses trade secrets or sensitive company information.
  3. Personal: A friend or acquaintance shares private details about your life.

To establish a breach of confidentiality, it must be proven that there was an expectation of privacy and that the disclosure caused harm.

Legal Grounds for Suing for Breach of Confidentiality

Denver Civil Litigation AttorneyIn Denver, Colorado, you can sue for breach of confidentiality under certain legal theories:

  1. Breach of Contract: If a confidentiality agreement is in place, and it is violated, you can sue for breach of contract. This is common in employment agreements and non-disclosure agreements (NDAs).
  2. Breach of Fiduciary Duty: Certain relationships, such as those between a lawyer and client or a doctor and patient, involve fiduciary duties. Breaching confidentiality in these relationships can lead to legal action for breach of fiduciary duty.
  3. Invasion of Privacy: Under Colorado law, you can sue for invasion of privacy if someone publicly discloses private facts about you that are offensive and not of legitimate public concern.
  4. Negligence: If someone negligently handles your confidential information, leading to its unauthorized disclosure, you may have grounds for a negligence claim.

Elements of a Breach of Confidentiality Claim

To successfully sue for breach of confidentiality, you generally need to prove the following elements:

  1. Existence of a Confidential Relationship: Demonstrate that there was a relationship where confidentiality was expected, such as between a patient and doctor or an employer and employee.
  2. Breach of Confidentiality: Show that the defendant disclosed confidential information without your permission.
  3. Damages: Prove that you suffered harm as a result of the breach. This could be emotional distress, financial loss, or reputational damage.
  4. Causation: Establish a direct link between the breach of confidentiality and the damages you suffered.

Steps to Take if Confidentiality is Breached

If you believe your confidentiality has been breached, here are the steps you should take:

  1. Document the Breach: Gather evidence of the breach, including communications, documents, and any other relevant information.
  2. Assess the Damage: Determine the extent of the harm caused by the breach. This can include emotional distress, financial loss, and damage to your reputation.
  3. Consult an Attorney: Contact a qualified attorney to discuss your case. An experienced lawyer can help you understand your legal options and guide you through the process.
  4. File a Complaint: If you decide to pursue legal action, your attorney will help you file a complaint in the appropriate court.

Legal Remedies for Breach of Confidentiality

If you successfully prove a breach of confidentiality, there are several legal remedies available:

  1. Compensatory Damages: You may be awarded damages to compensate for the harm caused by the breach. This can include medical expenses, lost wages, and compensation for emotional distress.
  2. Punitive Damages: In cases of particularly egregious behavior, the court may award punitive damages to punish the defendant and deter similar conduct in the future.
  3. Injunction: The court may issue an injunction to prevent further disclosure of confidential information.
  4. Specific Performance: In some cases, the court may order the defendant to comply with the terms of a confidentiality agreement.

Common Defenses Against Breach of Confidentiality Claims

When pursuing a breach of confidentiality claim, it’s essential to be aware of common defenses the defendant may raise:

  1. Consent: The defendant may argue that you consented to the disclosure of the information.
  2. Public Interest: The defendant might claim that the disclosure was in the public interest and therefore justified.
  3. Lack of Confidentiality: The defendant could argue that the information was not confidential or that there was no expectation of privacy.
  4. Statute of Limitations: The defendant may assert that the claim is barred by the statute of limitations. In Colorado, the statute of limitations for breach of confidentiality claims varies depending on the legal theory but is generally between two and six years.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
