Colorado Misdemeanor Sentencing Guidelines

Facing misdemeanor charges in Colorado might initially seem minor compared to felony charges, but the consequences can still significantly impact your life. Understanding Colorado’s misdemeanor sentencing guidelines is essential, as penalties can include substantial fines, probation, community service, mandatory counseling, and jail time. For residents of Denver, knowledge of these sentencing guidelines and the nuances involved can empower you to make informed legal decisions, whether you are currently charged or are seeking information for a loved one.

At Baker Law Group, PLLC, we have substantial experience representing clients in misdemeanor cases throughout Denver and Colorado. This post will detail Colorado’s misdemeanor sentencing guidelines, explaining the potential penalties and what you might expect in court proceedings.

What is a Misdemeanor in Colorado?

Under Colorado law, a misdemeanor is a criminal offense categorized as less severe than a felony but more serious than a petty offense. Misdemeanors often cover crimes such as minor theft, certain types of assault, domestic violence incidents, vandalism, disorderly conduct, traffic offenses, and drug-related offenses such as possession of small amounts of controlled substances.

Colorado recently revised its misdemeanor sentencing guidelines, simplifying the classification of misdemeanor offenses. This updated framework clarifies penalties, giving defendants and their attorneys a clearer understanding of potential sentencing outcomes.

Colorado’s Misdemeanor Classifications and Penalties

As of March 2022, Colorado law categorizes misdemeanors into two classifications: Class 1 misdemeanors and Class 2 misdemeanors. Each class carries different sentencing ranges:

Class 1 Misdemeanors

Class 1 misdemeanors represent the most serious category of misdemeanors in Colorado. Examples include third-degree assault, harassment, theft involving property valued between $300 and $1,000, and certain domestic violence offenses.Denver misdemeanor lawyer

Penalties for Class 1 Misdemeanors:

  • Jail Time: Up to 364 days in county jail.
  • Fines: Up to $1,000, which may vary depending on the offense.
  • Probation and Community Service: Courts may order probation, counseling programs, anger management classes, community service hours, or restitution to victims.

Given their seriousness, Class 1 misdemeanor convictions can significantly affect your future, leading to a criminal record, difficulties finding employment, or challenges securing housing.

Class 2 Misdemeanors

Class 2 misdemeanors are considered less severe but can still carry substantial consequences. Common examples include certain forms of criminal mischief, lower-value theft (less than $300), and minor drug possession charges.

Penalties for Class 2 Misdemeanors:

  • Jail Time: Up to 120 days in county jail.
  • Fines: Generally up to $750, though specific amounts vary by offense.
  • Probation and Rehabilitation Programs: Probation terms often include community service, mandatory counseling, substance abuse evaluations, and restitution payments if property damage or victim losses occur.

Although penalties for Class 2 misdemeanors are comparatively lighter than Class 1 misdemeanors, a conviction still creates a criminal record. Understanding your options and legal rights in these cases is crucial.

Special Sentencing Considerations in Colorado

In some instances, misdemeanor sentencing in Colorado involves unique factors or aggravating circumstances that can affect penalties. These include:

Domestic Violence Enhancements

Any misdemeanor involving domestic violence typically carries additional penalties. Colorado courts often require defendants to complete domestic violence counseling and treatment programs. Domestic violence misdemeanors also trigger protective orders and firearm restrictions.

Drug Offense Misdemeanors

Colorado sentencing for misdemeanor drug offenses frequently includes court-mandated substance abuse evaluations, counseling programs, community service, probation, and drug testing. Completing treatment programs can sometimes reduce or dismiss charges, emphasizing the importance of skilled legal guidance.

Habitual Offenders and Repeat Misdemeanor Convictions

Repeated misdemeanor convictions, even for minor offenses, may result in progressively harsher sentencing outcomes. A history of misdemeanor convictions could persuade the court to impose longer jail sentences, higher fines, and stricter probation terms. Consulting a knowledgeable Denver misdemeanor lawyer early can help minimize these potential outcomes.

Alternative Sentencing Options

Colorado courts increasingly consider alternative sentencing measures for rehabilitation instead of strictly punitive outcomes. Depending on the circumstances surrounding your misdemeanor charges, a skilled defense attorney from Baker Law Group, PLLC may advocate for alternative sentencing options such as:

  • Deferred Judgment and Sentencing: Allows eligible defendants to avoid conviction by successfully completing probationary terms, community service, or treatment programs.
  • Diversion Programs: Offer rehabilitative alternatives that, if completed successfully, can result in charges being dismissed entirely.
  • Community Corrections or Work Release Programs: Provide supervised alternatives to jail, allowing offenders to maintain employment or educational responsibilities.

Navigating these alternatives often requires the guidance of an experienced misdemeanor defense attorney who understands Denver’s specific judicial processes and requirements.

Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
