How Does Child Support Work in Joint Custody Cases in Denver?

Child support plays a vital role in ensuring that children receive the financial support they need from both parents, even in joint custody situations. In Denver, Colorado, understanding how child support operates in joint custody cases is crucial for parents to manage their responsibilities effectively. At Baker Law Group, we are committed to providing clear, accurate information to help you navigate these complexities. This article will explore how child support is determined and enforced in joint custody cases and offer guidance on how to address related issues.

Understanding Joint Custody in Denver

In Denver, joint custody refers to an arrangement where both parents share the legal and/or physical custody of their child. This arrangement can be:

  • Joint Legal Custody: Both parents have the right to make significant decisions regarding their child’s upbringing, including education, healthcare, and religion.
  • Joint Physical Custody: The child spends substantial time living with both parents, although not necessarily an equal amount of time.

Joint custody arrangements aim to provide a balanced involvement of both parents in their child’s life. However, even with joint custody, one parent may still be required to pay child support, depending on various factors.

Colorado Child Support Guidelines

In Denver, child support is primarily governed by the Colorado Child Support Guidelines, as outlined in the Colorado Revised Statutes (C.R.S. § 14-10-115). These guidelines use a formula to calculate child support obligations based on:

  • Parental Income: The gross income of both parents, including wages, bonuses, and other sources.
  • Custody Arrangement: The amount of time the child spends with each parent affects the support calculation.
  • Additional Expenses: Healthcare, childcare, and educational costs are factored into the support amount.

Determining Child Support in Joint Custody Cases

In joint custody cases, child support calculations are influenced by several factors. Here’s how the process generally works:

1. Income of Both ParentsDenver child support lawyer

The income of both parents is a primary factor in determining child support. The Colorado Child Support Guidelines take into account each parent’s gross income, including wages, self-employment income, and other earnings.

Income Calculation

  • Gross Income: Total earnings before taxes or deductions.
  • Adjustments: Certain deductions, such as for other children or spousal support, may be considered.

2. Parenting Time

The amount of time the child spends with each parent can impact the child support calculation. In joint custody cases, the time-sharing arrangement is evaluated to determine how it affects the financial responsibilities of each parent.

Parenting Time Considerations

  • Shared Time: If parenting time is nearly equal, the child support amount may be adjusted accordingly.
  • Deviation from Guidelines: The court may deviate from the standard guidelines if the time-sharing is not equal.

3. Child’s Needs

The child’s needs, including healthcare, education, and extracurricular activities, are considered when calculating child support. Both parents are responsible for contributing to these expenses based on their financial ability.

Expense Considerations

  • Healthcare Costs: Includes medical, dental, and vision expenses.
  • Educational Expenses: Covers school tuition, supplies, and extracurricular activities.
  • Childcare Costs: If applicable, includes daycare or after-school care.

4. Adjustments and Deviations

In some cases, the standard child support guidelines may not fully address the unique circumstances of a joint custody arrangement. Adjustments or deviations from the guidelines may be made to better reflect the parents’ financial situation and the child’s needs.

Adjustment Factors

  • Significant Income Disparities: If there is a substantial difference in income between the parents.
  • Special Needs of the Child: If the child has specific needs that require additional financial support.

Modifying Child Support in Joint Custody Cases

Changes in circumstances, such as a change in income or parenting time, may necessitate a modification of the child support order. In Denver, parents can request a modification by filing a motion with the court.

1. Filing for Modification

To request a modification of child support, the parent must file a motion with the court, demonstrating a substantial change in circumstances.

Modification Process

  • Motion Filing: Submit a motion detailing the reasons for the modification request.
  • Supporting Evidence: Provide evidence of the changed circumstances, such as income changes or changes in parenting time.
  • Court Review: The court will review the motion and supporting evidence to determine if a modification is warranted.

2. Legal Assistance

Consulting with a family law attorney, such as those at Baker Law Group, can be beneficial when seeking a modification. A Denver child support attorney can help prepare the necessary documentation, present your case effectively, and ensure that your rights are protected.

Addressing Common Issues in Joint Custody Child Support Cases

Joint custody cases can present unique challenges when it comes to child support. Here are some common issues and how to address them:

1. Disagreements Over Parenting Time

Disagreements over the amount of time each parent spends with the child can impact the child support calculation. If parents cannot agree on the parenting time arrangement, it may be necessary to seek mediation or court intervention.

Resolution Steps

  • Mediation: Engage in mediation to resolve disputes and reach a mutually agreeable parenting time schedule.
  • Court Intervention: If mediation is unsuccessful, the court may need to intervene and determine the appropriate parenting time arrangement.

2. Disputes Over Expenses

Disputes may arise regarding the allocation of additional expenses, such as healthcare or educational costs. Clear communication and documentation can help address these disputes.

Expense Management

  • Detailed Records: Keep detailed records of all expenses related to the child.
  • Open Communication: Discuss expenses with the other parent and seek to reach an agreement.

3. Changes in Financial Circumstances

Significant changes in financial circumstances, such as job loss or a substantial increase in income, may impact child support obligations. Parents should promptly address these changes by seeking a modification of the child support order if necessary.

Financial Changes

  • Immediate Action: If you experience a significant financial change, promptly file for a modification.
  • Documentation: Provide evidence of the change in circumstances to support your modification request.

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
