How to File a Civil Lawsuit in South Carolina

Filing a civil lawsuit in South Carolina can seem daunting, but understanding the process can make it more manageable. Whether you’re pursuing justice for a breach of contract, personal injury, or another legal dispute, knowing the steps involved can help you take informed action. At Baker Law Group, we’re here to guide you through this complex legal landscape.

Step 1: Determine Your Legal Standing and Claim

Before filing a lawsuit, ensure you have legal standing, which means you have a direct interest in the case and have suffered harm or damages. South Carolina law requires that your claim falls within the statute of limitations. For example, personal injury cases typically have a three-year limitation period, while contract disputes may vary. Consulting a civil litigation attorney can help you determine if your case is valid and timely.

Step 2: Identify the Appropriate Court

Civil lawsuits in South Carolina are generally filed in one of two types of courts: Magistrate’s Court or Circuit Court. Magistrate’s Court handles claims involving smaller amounts, usually up to $7,500. Circuit Court handles more complex cases with higher stakes, including personal injury claims, property disputes, and commercial litigation. Choosing the correct court is critical to avoid delays or dismissals.

Step 3: Draft and File the Complaint

The complaint is the document that initiates the lawsuit. It outlines the facts of your case, the legal basis for your claim, and the relief you seek, whether monetary or otherwise. South Carolina law requires complaints to adhere to strict procedural rules, including proper formatting and service of process.

Once your complaint is drafted, it must be filed with the appropriate court and accompanied by the applicable filing fee. In South Carolina, electronic filing is required in most courts for attorneys, while individuals may still file in person.

Step 4: Serve the Defendant

After filing your complaint, the defendant must be formally notified of the lawsuit through the service of process. This involves delivering a copy of the complaint and a summons informing the defendant of the case and their obligation to respond. In some circumstances, South Carolina rules allow service by a sheriff’s deputy, a private process server, or certified mail.

Proper service is crucial, as failure to serve the defendant correctly can delay your case or result in dismissal.

Step 5: The Defendant’s Response

Once served, the defendant has 30 days to respond to the complaint by filing an answer or a motion to dismiss. In their answer, the defendant may admit or deny the allegations and may assert counterclaims or defenses. If a motion to dismiss is filed, the court will first rule on whether the case can proceed before addressing the merits of your claim.

Step 6: Discovery PhaseGreenville civil litigation lawyer

Discovery is a critical phase in civil litigation, where both parties exchange information and evidence relevant to the case. Discovery tools in South Carolina include:

  • Interrogatories: Written questions that must be answered under oath.
  • Requests for Production: Demands for documents or other tangible evidence.
  • Depositions: Testimony from parties or witnesses taken under oath.
  • Requests for Admission: Statements the other party must admit or deny.

The discovery process helps clarify the facts, narrow the issues, and prepare both sides for trial. It can also create opportunities for settlement discussions.

Step 7: Pre-Trial Motions and Mediation

Before trial, either party may file pre-trial motions to resolve certain issues, such as motions for summary judgment, which ask the court to decide the case based on the undisputed facts.

South Carolina courts often encourage or require mediation as an alternative dispute resolution method. Mediation involves a neutral third party helping both sides reach a mutually agreeable settlement, potentially avoiding the need for a trial.

Step 8: Trial

If the case proceeds to trial, it will be heard before a judge or jury, depending on the nature of the case and the parties’ preferences. Both sides present their arguments, evidence, and witnesses during the trial. After hearing the case, the judge or jury will render a verdict.

Trials in South Carolina can vary in length, complexity, and cost, making it essential to work with an experienced civil litigation attorney who can effectively advocate for your interests.

Step 9: Post-Trial Motions and Appeals

If unsatisfied with the trial’s outcome, you may file a post-trial motion or appeal the decision to a higher court. South Carolina law provides specific timeframes and grounds for appeals, such as errors in the trial process or misinterpretation of the law.

Key Considerations When Filing a Civil Lawsuit

  • Costs and Fees: Filing, service, and attorney fees can add up. Understanding these costs upfront is crucial.
  • Burden of Proof: In civil cases, the plaintiff has the burden of proof, meaning you must provide sufficient evidence to support your claims.
  • Local Rules and Procedures: South Carolina courts have unique procedural rules that must be followed meticulously.

Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
