Legal Rights of Conservatees in Colorado: What You Need to Know

Navigating the complexities of conservatorship in Colorado can be challenging. Understanding the legal rights of conservatees is essential for ensuring that they are protected and that their best interests are served. At Baker Law Group, we are committed to helping you understand these rights and providing expert guidance through the conservatorship process.

Understanding Conservatorship in Colorado

A conservatorship is a legal relationship established by the court where a responsible person (the conservator) is appointed to manage the financial affairs of an individual (the conservatee) who is unable to do so due to mental or physical limitations. This legal arrangement is crucial for safeguarding the conservatee’s assets and ensuring their financial stability. The legal rights of conservatees are listed in Colorado’s Probate Code, otherwise known as C.R.S. Title 15.

Legal Rights of Conservatees

Colorado Springs Civil Litigation AttorneyRight to Notification

One of the fundamental rights of conservatees in Colorado is the right to be notified of the conservatorship proceedings. According to Colorado law, the proposed conservatee must receive notice of the hearing where the appointment of a conservator will be decided. This ensures transparency and provides the conservatee with an opportunity to be heard.

Right to Legal Representation

Conservatees have the right to legal representation throughout the conservatorship process. They can retain their own attorney, or if they are unable to do so, the court may appoint one for them. This right is vital for ensuring that the conservatee’s interests are adequately represented and protected in court.

Right to Participate in Proceedings

In addition to being notified of the proceedings, conservatees have the right to participate in the hearings. This participation can include attending the hearings, presenting evidence, and voicing their preferences regarding the appointment of the conservator. The court takes these inputs seriously when making its decision.

Right to Appeal

If the conservatee or any interested party is dissatisfied with the court’s decision regarding the conservatorship, they have the right to appeal. This ensures that there is a mechanism for reviewing and potentially overturning decisions that may not be in the best interest of the conservatee.

Financial Rights of Conservatees

Right to Manage Personal Finances

While a conservator is appointed to manage the conservatee’s financial affairs, the conservatee retains certain rights over their personal finances. Depending on their capacity, the conservatee may still be allowed to handle smaller financial matters or receive an allowance from their estate.

Right to Accountings

Conservatees have the right to receive regular accountings from their conservator. These accountings provide a detailed report of all financial transactions conducted on behalf of the conservatee, ensuring transparency and accountability in the management of their assets.

Right to Request Changes

If the conservatee believes that the conservator is not acting in their best interest or managing their assets appropriately, they have the right to request changes. This can include petitioning the court for the removal of the conservator or requesting modifications to the conservatorship arrangement.

Personal Rights of Conservatees

Right to Personal Freedom

Conservatees retain their personal rights and freedoms to the extent possible given their limitations. This includes the right to make decisions about their daily lives, such as where they live, their medical care, and other personal matters, as long as they have the capacity to do so.

Right to Dignity and Respect

It is essential that conservatees are treated with dignity and respect at all times. Conservators are legally and ethically obligated to act in the best interest of the conservatee, ensuring their well-being and respecting their personal preferences and values.

Right to Privacy

Conservatees have the right to privacy regarding their personal and financial affairs. Conservators must handle the conservatee’s information with confidentiality and avoid unnecessary disclosure of their private matters.

I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
