What Is the Difference Between Malicious Prosecution and Abuse of Process?

In the intricate realm of legal disputes, the nuances between various tort claims can significantly impact the course and outcome of litigation. Among the most commonly conflated concepts are malicious prosecution and abuse of process. Both terms refer to wrongful legal actions, yet they target distinctly different misconducts and are governed by unique legal standards.

This distinction is critical not only for legal practitioners but also for individuals navigating the legal system. Baker Law Group, a prominent law firm in Colorado, aims to demystify these concepts, providing clarity on their differences and guiding those affected toward seeking appropriate legal redress.

Malicious Prosecution: A Focus on Wrongful Litigation

Malicious prosecution pertains to the improper initiation or continuation of criminal or civil legal proceedings against someone, without probable cause and with malintent, which results in a resolution in favor of the defendant (the person against whom the case is brought).

This cause of action safeguards individuals from unjustified litigation that aims to harass, intimidate, or unduly burden them. The essential elements of a malicious prosecution claim include the initiation of proceedings by the defendant, the absence of reasonable grounds for the proceedings (lack of probable cause), malice in bringing the action, and termination of the proceedings in favor of the plaintiff (the person bringing the claim).

Abuse of Process: Misusing the Legal System

Conversely, abuse of process targets the misuse of the legal system’s procedural mechanisms, not for their intended purposes, but to accomplish an ulterior motive. This claim does not necessarily require the legal action to be initiated without probable cause or end in favor of the plaintiff. Instead, it focuses on the misuse of legal procedures once a lawsuit is underway. An abuse of process might involve using litigation tools, such as discovery mechanisms or court orders, in a manner that is not intended or sanctioned by law, to exert undue pressure or achieve an unrelated objective.

Key Differences

The primary difference between malicious prosecution and abuse of process lies in their focal points; the former concerns the wrongful initiation of legal proceedings, while the latter addresses the misuse of the procedures within those proceedings. Additionally, malicious prosecution requires the proceedings to end in favor of the plaintiff and necessitates proof of malice and lack of probable cause. In contrast, abuse of process can occur even when the initial lawsuit is legitimately founded, focusing instead on the perversion of the court’s processes for purposes divergent from those the law intends.

Legal Implications and Remedies

The implications of these torts are profound, as they touch on the fundamental justice principle that the legal system should not be used as a tool for personal vendettas or to achieve objectives outside the scope of legal proceedings. Victims of malicious prosecution or abuse of process may be entitled to compensatory damages for the harm suffered, which can include legal costs, emotional distress, and in some cases, punitive damages aimed at deterring such conduct in the future.

I had a great experience with Baker Law Group. Robert helped my business with a mechanics lien and I would not hesitate to contact them again!
Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
