Why Choose Civil Litigation Over Arbitration

When facing a legal dispute, individuals and businesses often grapple with whether to choose civil litigation or arbitration. Each option has its advantages and disadvantages, and the decision can significantly impact the case outcome.

At Baker Law Group, we believe that understanding the differences between these two dispute resolution methods can help you make an informed decision. Here’s why you might choose civil litigation over arbitration.

Understanding Civil Litigation and Arbitration

Civil LitigationColorado Springs Civil Litigation Attorney is the process of resolving disputes through the court system. It involves filing a lawsuit, engaging in the discovery process, and potentially going to trial before a judge or jury. Civil litigation is typically public, with court records accessible to the public unless sealed by a court order.

Arbitration, on the other hand, is a private form of dispute resolution where the parties agree to submit their dispute to one or more arbitrators, who render a binding decision. Arbitration is generally faster and more confidential than litigation, and the arbitrator’s decision is typically final, with limited grounds for appeal.

Reasons to Choose Civil Litigation Over Arbitration

  1. Public Record and Transparency

Civil litigation is a public process, providing transparency and accountability. Court proceedings and decisions are generally accessible to the public, ensuring that justice is not only done but seen to be done. This transparency can be crucial in cases involving public interest, corporate accountability, or where a party wants to set a legal precedent.

  1. Right to Appeal

One of the significant advantages of civil litigation is the right to appeal. If you are dissatisfied with the outcome of your case, you can appeal the decision to a higher court. This multi-tiered review process helps ensure that errors made by the trial court can be corrected, providing a critical safeguard against unjust outcomes. In contrast, arbitration offers very limited opportunities for appeal, which can be a significant drawback if the arbitrator’s decision is flawed.

  1. Procedural Protections

The court system provides extensive procedural protections that are often not available in arbitration. These include the rules of evidence and civil procedure, which govern how evidence is presented and disputes are managed. These rules help ensure a fair process and protect the rights of all parties involved. In arbitration, the arbitrator has more flexibility and can sometimes disregard formal procedures, which may lead to a less predictable and potentially less fair outcome.

  1. Comprehensive Discovery Process

Civil litigation allows for a thorough discovery process, where parties can obtain evidence from each other and third parties. This process includes depositions, interrogatories, requests for documents, and subpoenas. The comprehensive nature of discovery in litigation can be critical in uncovering relevant facts and building a strong case. Arbitration, in contrast, typically has a more limited discovery process, which might disadvantage parties needing extensive evidence to support their claims.

  1. Enforceability of Judgments

Judgments from civil litigation are generally easier to enforce than arbitration awards. Courts have established mechanisms for enforcing judgments, including garnishment of wages and seizure of assets. While arbitration awards are also enforceable, the process can be more complicated and may require additional legal steps to confirm the award in court.

  1. Precedential Value

Decisions made in civil litigation can set legal precedents that guide future cases. This is particularly important in complex legal areas where consistent legal principles are necessary. Arbitration decisions, however, are typically not published and do not have precedential value, meaning they cannot be used to guide future disputes.

I had a great experience with Baker Law Group. Robert helped my business with a mechanics lien and I would not hesitate to contact them again!
Carl and his team are amazing. They are thorough, knowledgeable, timely, and transparent. I worked with them through a case for close to a year and Carl made sure I was always informed and prepared every step of the way. I couldn’t be more grateful for the hard work the team put in and for the peace of mind knowing I had them behind me. I hope I don’t have to, but if needed, I’d reach out to the firm again in a heartbeat!

Shortly after construction was finished on our new home we received a large unexpected bill from our General contractor. We did not agree with this bill so the general contractor tried to force/scare us into paying it by having his attorney write us a demand letter and placing a lien on our home. The contractor nor their attorney would respond to me. I reached out to Baker Law group and spoke with Robert Harper.
Robert was amazing. It was clear he had dealt with situations like this many times before. Without hesitation or pressure to sign a contract, Robert took the time to explain how the lien process works and gave me suggestions on how to properly handle the situation. Thanks to Roberts experience and advice, I was able to confidently communicate with the contractors attorney and the $60,000 lien was removed in less than a week and It didn’t cost me a dime. I can not thank Robert enough for sharing his knowledge, experience and wisdom. I will not hesitate calling Robert in the future and highly recommend him. He is a true credit to his profession and the only attorney I will use in the future.
